1. Acceptance of Terms

By accessing or using the Qustomer platform, including our loyalty programs, POS system, reservations, automations, and customer engagement tools, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

Qustomer provides a unified platform for businesses to manage loyalty programs, point-of-sale operations, reservations, rewards, and customer engagement. Our services include but are not limited to:

• Loyalty program creation and management
• POS system integration and operations
• Reservation and booking management
• Automated customer engagement workflows
• Analytics and reporting dashboards
• Customer data management and insights

3. User Accounts

To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify Qustomer immediately upon becoming aware of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Qustomer platform to:

• Violate any applicable local, national, or international law or regulation
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the integrity or performance of the service
• Attempt to gain unauthorized access to the service or its related systems
• Use the platform to send unsolicited communications or spam
• Collect or harvest personal information of other users without consent

5. Payment Terms

Certain features of Qustomer require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. All fees are non-refundable unless otherwise stated.

We reserve the right to change our pricing at any time. If we change pricing for a plan you are currently subscribed to, we will notify you at least 30 days before the change takes effect. Continued use of the service after the price change constitutes your agreement to the new pricing.

6. Intellectual Property

The Qustomer platform, including its original content, features, and functionality, is owned by Qustomer and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit, post, or display on or through the service. By submitting content, you grant Qustomer a worldwide, non-exclusive license to use, reproduce, and display such content solely for the purpose of providing the service.

7. Data Processing

As a data processor, Qustomer processes personal data on your behalf in accordance with our Data Processing Agreement (DPA) and applicable data protection laws, including the GDPR. You remain the data controller for all customer data you input into the platform.

You are responsible for ensuring that you have the necessary consents and legal bases to collect and process personal data through our platform.

8. Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or for reasons beyond our control.

Qustomer shall not be liable for any loss or damage arising from service interruptions, delays, or failures beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, Qustomer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the service.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to Qustomer in the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the service will cease immediately. You may export your data before termination. After termination, we will delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Pokhara, Kaski, Nepal.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on our website and updating the effective date. Your continued use of the service after changes are posted constitutes your acceptance of the revised terms.
